1. Introduction

Welcome to BettaLearn, operated by BettaLearn Pty Ltd, an Australian registered company (“BettaLearn”, “we”, “us”, “our”), located in Sydney, Australia.

These Terms and Conditions (“Terms”) govern access to and use of the BettaLearn platform, website, mobile application, and related services (collectively, the “Platform”).

By accessing or using BettaLearn, you agree to be legally bound by these Terms.

If you do not agree, you must not use the Platform.

2. Nature of the Platform

BettaLearn is:

  • A social networking platform designed for homeschooling families and educators
  • A marketplace connecting Parents/Guardians and Educators
  • A content-sharing platform allowing posts, images, comments, stories, events, and communities

BettaLearn does not:

  • Provide formal accredited education
  • Employ Educators
  • Guarantee educational outcomes
  • Act as an agent between Parents and Educators

We are a technology platform only.

3. Eligibility

3.1 Parent/Guardian Accounts

  • You must be at least 18 years old to register as a Parent or Guardian.
  • You represent that you have legal authority over any Student profile you create.

3.2 Student Accounts

  • Minimum age: 7 years old
  • Student profiles must be created and fully controlled by a Parent or Guardian.
  • Parents may switch between their account and the Student account.
  • Parents are fully responsible for all activity conducted via Student accounts.

3.3 Educator Accounts

  • Minimum age: 16 years old
  • Educators under 18 must have parental/guardian consent.
  • BettaLearn does not independently verify qualifications and age unless otherwise stated.

4. Account Responsibilities

You agree to:

  • Provide accurate information
  • Maintain account security
  • Notify us of unauthorized access
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts at our sole discretion.

5. Student Privacy & Visibility Rules

To protect Students:

  • Only the initial of the Student’s first name and their full last name is visible by default.
  • Full names become visible only when mutual following occurs.
  • Parents maintain full control over Student visibility and activity.

We reserve the right to modify visibility features to enhance safety.

6. Subscription & Payments (Educators)

6.1 Fees

Educators are charged $4.99 AUD per month, converted into local currency where applicable.

6.2 First Month Free

BettaLearn may offer promotional free trial periods. After the trial, billing begins automatically unless cancelled.

6.3 Payment Processors

Payments are processed via:

  • Stripe
  • PayPal (when introduced)

We do not store full payment details.

6.4 Cancellation

Educators may cancel anytime. No partial refunds are provided unless required under Australian Consumer Law.

7. Marketplace Disclaimer

BettaLearn:

  • Does not employ Educators
  • Does not supervise lessons
  • Is not responsible for contracts formed between Parents and Educators
  • Does not guarantee quality, safety, or outcomes

All arrangements are made directly between users.

8. Content & Conduct

Users may upload:

  • Posts
  • Images
  • Comments
  • Stories (24-hour format)
  • Events
  • Community content

You must not upload:

  • Illegal content
  • Harmful or abusive material
  • Child exploitation material
  • Harassment or bullying
  • Misleading or fraudulent content
  • Copyright-infringing material

We reserve the right to remove content at our sole discretion.

9. Moderation

BettaLearn intends to actively moderate content. However, moderation may at times be reactive due to operational limitations.

We provide reporting tools. Users are encouraged to report violations.

We are not liable for user-generated content but reserve the right to remove it.

10. Termination

We may suspend or terminate any account:

  • With or without notice
  • For any breach
  • If we believe safety is at risk
  • If required by law

Termination does not limit our legal rights.

11. Intellectual Property

All Platform materials (branding, logo, software, design, content structure) belong to BettaLearn Pty Ltd.

Users retain ownership of content they upload but grant BettaLearn a worldwide, non-exclusive, royalty-free license to display and distribute that content within the Platform.

12. Privacy & Data Protection

We comply with:

  • Australian Privacy Act 1988
  • UK GDPR
  • PIPEDA (Canada)
  • COPPA (United States)
  • New Zealand Privacy Act 2020

Cross-border data transfers may occur.

14. Disclaimer of Educational Advice

Content on BettaLearn is for informational purposes only.

We do not guarantee academic results, accreditation, or compliance with local homeschooling regulations.

Parents remain responsible for compliance with their local laws.

15. Limitation of Liability

To the maximum extent permitted by law:

BettaLearn is not liable for:

  • Indirect or consequential losses
  • Loss of income or reputation
  • Disputes between users
  • User-generated content
  • Platform interruptions

Nothing excludes rights under Australian Consumer Law.

16. Indemnity

You agree to indemnify BettaLearn Pty Ltd from any claims arising from:

  • Your use of the Platform
  • Breach of these Terms
  • Violation of laws
  • Content you upload

17. Governing Law

These Terms are governed by the laws of Australia.

Users agree to submit to the jurisdiction of Australian courts.

18. Changes to Terms

We may update these Terms at any time.

Continued use of the Platform constitutes acceptance of changes.
