1. Purpose
This Educator Agreement (“Agreement”) governs the relationship between BettaLearn Pty Ltd (“BettaLearn”, “we”, “us”, “our”) and any individual registering as an Educator on the BettaLearn platform (“Platform”).
By registering as an Educator, you agree to be legally bound by this Agreement, in addition to our:
- Terms and Conditions
- Privacy Policy
- Acceptable Use Policy
- Community Guidelines
- Child Safety & Safeguarding Policy
2. Eligibility
To register as an Educator, you must:
- Be at least 16 years old
- Have legal capacity to enter into binding contracts
- Provide accurate registration information
BettaLearn reserves the right to verify identity where necessary.
3. Independent Contractor Status
Educators are independent users of the Platform.
Nothing in this Agreement creates:
- An employment relationship
- A partnership
- An agency relationship
- A joint venture
Educators are solely responsible for their services, conduct, and compliance with laws.
4. Services & Representation
Educators may:
- Advertise educational services
- Share qualifications
- Post learning resources
- Connect with Parents
Educators must not:
- Misrepresent credentials
- Make false claims about accreditation
- Guarantee outcomes
You warrant that all information provided is accurate and not misleading.
5. Subscription & Payment
Educators agree to:
- Pay the monthly subscription fee of $4.99 AUD (converted to local currency where applicable)
- Authorise recurring charges via approved payment processors
- Cancel prior to renewal if discontinuing services
Non-payment may result in suspension or termination.
6. Child Safety Obligations
Educators agree to:
- Maintain professional boundaries
- Avoid inappropriate communication
- Not request private contact details from Students
- Avoid off-platform contact with Students without parental involvement
- Immediately report safety concerns
Violation may result in immediate termination and referral to authorities.
7. Compliance with Laws
Educators are responsible for complying with:
- Local homeschooling regulations
- Tax obligations
- Child protection laws
- Business licensing requirements
- Any mandatory background check requirements in their jurisdiction
BettaLearn does not verify legal compliance unless explicitly stated.
8. Background Checks
At launch, BettaLearn does not require mandatory background checks.
However, we reserve the right to:
- Introduce verification requirements
- Request documentation
- Suspend accounts pending review
Educators acknowledge that Parents are responsible for conducting due diligence.
9. Marketplace Disclaimer
BettaLearn:
- Does not supervise lessons
- Is not a party to contracts formed between Parents and Educators
- Does not guarantee payment
- Does not guarantee bookings
- Is not responsible for disputes
All arrangements are made independently between users.
10. Intellectual Property
Educators retain ownership of their content.
By uploading content, Educators grant BettaLearn a non-exclusive, worldwide, royalty-free licence to display and promote that content within the Platform.
Educators warrant that they have rights to all materials shared.
11. Indemnification
Educators agree to indemnify BettaLearn against any claims arising from:
- Services provided
- Misrepresentation
- Breach of this Agreement
- Violation of laws
- Disputes with Parents or Students
12. Limitation of Liability
To the maximum extent permitted by law, BettaLearn is not liable for:
- Loss of income
- Business interruption
- Disputes between users
- Service dissatisfaction
- Educational outcomes
Nothing excludes rights under Australian Consumer Law.
13. Suspension & Termination
BettaLearn may suspend or terminate Educator accounts:
- For policy violations
- For safety concerns
- For non-payment
- At our discretion
Termination may occur without prior notice.
No refunds will be provided where termination results from breach.
14. Reputation & Conduct
Educators agree not to:
- Damage the reputation of BettaLearn
- Publicly misrepresent platform policies
- Engage in conduct that undermines platform integrity
15. Amendments
We may update this Agreement from time to time.
Continued use of the Platform constitutes acceptance of changes.
16. Governing Law
This Agreement is governed by the laws of Australia.
Educators submit to the jurisdiction of Australian courts.
